Terms and Conditions
This document establishes the General Terms and Conditions of Contract for the website, the purpose of which is the purchase of Spanish lessons from Juan Miguel Comas García by individuals and/or legal entities (hereinafter, the “contracting party” or “user”) who express their intention to acquire the products made available to them in the store of this website by submitting a request via electronic means.
1. Contractual Information and Documentation. Acceptance of the Contract
These General Terms and Conditions of Contract are permanently displayed on the website, owned by Juan Miguel Comas García, allowing any user to save or print them and, therefore, to be informed in advance of the conditions under which the products offered in the store (hereinafter, the “product”) will be contracted.
Likewise, these General Conditions are reiterated along with a summary of the specific request — the specific product(s) contracted, cost including applicable taxes, shipping costs, etc. — for express acceptance by the contracting party by clicking “I have read and accept the terms and conditions” each time a specific request is made through the website.
It is not technically possible for the contracting party to complete the request without having accepted these General Conditions. In order to provide such acceptance and therefore submit the request, the contracting party must provide their details when placing the order on this website, at which point they accept these Conditions and the Privacy Policy of the website.
By accepting these Conditions, the contracting party grants their express and unconditional consent for Juan Miguel Comas García to carry out the necessary payment collection operations for the acquisition of the contracted product, expressly authorizing him to make such charges using the payment methods selected or entered in the secure area provided for this purpose, in accordance with applicable payment services regulations.
These General Conditions, together with the specific request made via the Internet by the contracting party — also referred to as the “Particular Conditions” — constitute the content of the contract between Tu profe de español and the contracting party, who declares having sufficient capacity to contract and having read, understood, and accepted these conditions.
The website owner, upon completion of the transaction and within no more than 24 hours, will send confirmation of the order placed to the email address associated with the contracting party’s account.
The contracting party will have permanent access to these General Conditions on the website. Any subsequent modification to these General Conditions will be clearly displayed in an easily accessible location on the website. All aforementioned documentation may be printed and saved by the contracting party, and may be requested at any time from Customer Service via email at: juanmiguelcomas@gmail.com.
2. Purpose
By this contract, Juan Miguel Comas García undertakes to deliver to the contracting party the product they have requested through the website in exchange for a specified price and under the conditions set forth in this document.
3. Rights and Obligations of the Website Owner
Under no circumstances will the owner be responsible for:
Errors or delays in access by the contracting party when entering their data in the order form, slow or impossible order confirmation, or any anomaly that may arise when such incidents are due to Internet network issues, force majeure, or any other unforeseeable contingency beyond the owner’s good faith. In all cases, the website owner undertakes to resolve any problems that may arise and to provide all necessary support to the contracting party for a quick and satisfactory resolution of the incident.
Errors or damages caused by inefficient or bad-faith use of the product by the contracting party.
The inoperability of the email address provided by the contracting party for sending order confirmations.
4. Rights and Obligations of the Contracting Party
4.1. Payment
The contracting party undertakes to pay the amount for the product actually requested in the quantity and manner established in these Conditions.
This website has an SSL (Secure Socket Layer) security certificate. This security standard allows secure and encrypted data transfer between the user and the website. A secure connection is established when:
The security certificate guarantees the authenticity of the website (it is not a fraudulent site).
It encrypts the information transferred from the user’s browser to the web server hosting the site.
4.1.1. Amount
The remuneration for the product requested by the contracting party will be as stated on the website and in the specific order placed (except in the case of a typographical or obvious error). These requests will constitute the particular conditions of the order. The price listed on the website is always in euros, including taxes.
If an error occurs in the price of the requested product, Juan Miguel Comas García will inform the contracting party as soon as possible and offer the option to reconfirm the order at the correct price or cancel it. If contact cannot be made with the contracting party, the order will be deemed cancelled, and any amounts paid will be fully refunded without any right to compensation.
The final price will include: applicable taxes or fees, any increases or discounts applied to the offer, and any additional charges — for example, those related to payment methods — which will be expressly accepted by the contracting party.
Juan Miguel Comas will issue a receipt for the contracted product detailing all relevant charges. The contracting party expressly consents to receive the invoice electronically at the email address provided when placing the order.
4.1.2. Payment Methods
The contracting party must pay for the contracted product using one of the available payment methods listed on the website.
The website complies with SSL protocol standards, ensuring a secure and private transaction and guaranteeing that Tu profe de español cannot access or store any data provided by the customer during payment via virtual POS.
Any additional charges associated with the selected payment method must be paid and confirmed separately as indicated on the website. PayPal has additional associated fees.
4.1.3. Lesson Package Expiration
By purchasing a lesson package, the student agrees to complete all included lessons within a maximum of 6 months from the date of purchase. If, after 6 months, there are remaining lessons, they will be automatically cancelled unless a duly justified case of force majeure occurs.
Force majeure events include, but are not limited to, serious illness, accidents, bereavement, natural disasters, armed conflict, and other events beyond the student’s control that prevent them from fulfilling their commitment within the established period.
If the student needs to request an extension due to force majeure, they must notify us in writing before the 6-month period expires. Any extension will be subject to our approval and must be reasonable according to the specific circumstances preventing the student from meeting the original deadline.
4.2. Withdrawal
The contracting party, provided they are considered a consumer under applicable law, may withdraw from the contract made through this website without justification within 14 calendar days from the delivery of the last product included in the contract.
The right of withdrawal does not apply to products made according to the contracting party’s specifications or clearly personalized.
To exercise the right of withdrawal, the contracting party must notify their decision to withdraw from the contract via an unequivocal statement to: Juan Miguel Comas García, by email at: juanmiguelcomas@gmail.com, stating that they are withdrawing from the contract and providing their full name. They may also use the withdrawal form provided under consumer protection regulations. If submitted on paper, the withdrawal request must be signed by the contracting party. To meet the withdrawal deadline, it is sufficient to send the notification before the period expires.
In the event of withdrawal by the contracting party, Tu profe de español will refund all payments received, except for payments received for lessons already completed. The refund will be made using the same payment method as the initial transaction unless expressly agreed otherwise. The contracting party will not incur any fees as a result of the refund. Tu profe de español may withhold the refund until the products have been received or proof of return has been provided.
5. Termination
Either party may terminate this contract for any reason provided for by law and, in particular, for breach of these General Conditions. Termination may be exercised by contacting the other party via the email address provided by the contracting party at the time of service contracting, identifying the specific contract to be terminated.
6. Copyright and Trademark
The user is informed that the website’s own content, programming, and design are fully protected by copyright, and any reproduction, communication, distribution, or transformation of such protected elements is expressly prohibited without the author’s consent.
This website may occasionally use external sources for its content and/or establish links or hyperlinks to third-party articles or information, always citing the source. The rightful copyright holder of such information may request its removal at any time.
7. Data Protection
The data provided by the contracting party under these General Conditions will be processed as stipulated in the Privacy Policy published on the website.
8. Jurisdiction and Applicable Law
These General Conditions are governed by Spanish law. The Courts of Majadahonda (Madrid) shall have jurisdiction to resolve any dispute arising from these General Conditions, with the contracting party expressly waiving any other jurisdiction that may apply. Consumers may use the online dispute resolution platform for disputes arising from online sales or service contracts, accessible at: http://ec.europa.eu/odr.
9. Other
If any clause of this document is declared null and void, the remaining clauses will remain in force and will be interpreted according to the will of the parties and the purpose of these conditions. This contract is made exclusively in Spanish. The website owner may choose not to exercise any rights or powers granted herein, which will not in any case imply a waiver of them unless expressly acknowledged.
